Overview:
Our client was 25-year-old man charged with dangerous operation of a motor vehicle with the aggravating factor of participating in an illegal race. While on a public motorway our client raced another vehicle, reaching speeds above 120km/h while weaving in and out of the other traffic on the road.
When questioned by police he made admissions to participating in an illegal race.
Based on our advice, our client undertook the Queensland Traffic Offenders Program prior to attending court.
Appearing on Sentence, Mr O’Neill made submissions regarding our client’s remorse, minor existing traffic history, completion of and genuine engagement with the Queensland Traffic Offenders Program. Mr O’Neill also informed the court of the negative impact the recording of a conviction would have upon our client due to his position in a company that worked on government contracts.
In the circumstances Mr O’Neill submitted that a fine and the minimum disqualification of 6 months were appropriate. The court agreed with these submissions fining our client $2,500.00 and disqualifying him from driving for 6 months. No conviction was recorded.
