Our client was charged with public nuisance. It was alleged after a big night out drinking and leaving the hotel our client was located by police in a nearby carpark yelling profanities at the police. Despite warnings our client continued to swear at police.
If convicted of this offence, our client would have been in breach of a probation order and facing an order of imprisonment. We wrote to the Prosecution noting relevant case law that dealt with the issue of swearing at police and urging them to reconsider the proceedings against our client.
