Our client was charged with contravening a direction and failing to leave licensed premises after refusing to leave the Star Casino upon the request of both security and the police.
Our client had no previous criminal history.
Both charges had the ability to be dealt with by way of infringement notices. Our client instructed us to write to the prosecution requesting that they issue an infringement notice for one of the offences and discontinue proceedings in relation to the second charge, on the basis that the facts for the charges were similar.
The police and prosecution accepted our request, and subsequently issued an infringement notice to our client for the contravening a direction charge, which resulted in a $783.30 fine.
We appeared in the Southport Magistrates Court on 7 August 2018, at which time the prosecution formally discontinued the charges. The court dismissed the charges, and our client was discharged.
