Offence/s:

  1.  Possess dangerous drugs (Cocaine)

Solicitor: Sinead Garland

Court: Southport Magistrates Court

Date: September 2018

Our client and his friends rented a unit on the Gold Coast for a friend’s birthday. After a long night of celebrations, our client and his friends returned to the unit in the early hours of the morning. At this time, a clip seal bag containing cocaine was produced. Later that morning, our client’s friend became affected by the drugs and became aggressive by threatening the occupants of the apartment with a knife. For his friend’s wellbeing, our client called 000 for assistance. When the police arrived, they noticed that there was a white plate containing 1 line of cocaine (estimated to be less than .05grams) on the kitchen bench. Next to the plate, was a rolled up 5 dollar note. Our client made full admissions to police stating that the drugs were his. Our client was subsequently charged with possessing a dangerous drug.

Our client sought legal advice from Ms Garland of our office and indicated that he may in the future seek to work in law enforcement. Therefore, it was important in his circumstances not to have a criminal conviction recorded. In addition, our client requested that his matter be dealt with expeditiously.

Based on our client’s instructions, we arranged for the matter to be resolved on the first occasion by way of a guilty plea.

WARNING:

This is a summary of an actual case. Details have been omitted to protect the privacy of our client. We select cases which are informative and no guarantee is provided that similar results are achievable in all cases. Every case is different and you should obtain legal advice specific to your matter and circumstances.

Our client ultimately plead guilty to the reduced charges and received a wholly suspended sentence of imprisonment, not requiring him to serve any further time in custody.
