Police Application for a Protection Order (Police Protection Notice)

Potts Lawyers > Our Results  > Domestic Violence > Police Application for a Protection Order (Police Protection Notice)

Matter:

  1. Application to vary DVO (extend order)

Solicitor: Erin Mitchell

Court: Southport Magistrates Court

Date: 2018

Police issued a police protection notice to our client after receiving a complaint from his wife. It was alleged that he had taken photos of the private contents of her phone and shown the contents to other persons in her family. We made submissions to the Prosecution requesting that they discontinue the proceedings against our client. We made submissions highlighting the weaknesses in their case and noting that the Court could not be satisfied that a protection order (DVO) was necessary or desirable.

WARNING:

This is a summary of an actual case. Details have been omitted to protect the privacy of our client. We select cases which are informative and no guarantee is provided that similar results are achievable in all cases. Every case is different and you should obtain legal advice specific to your matter and circumstances.

Ultimately, they accepted our submissions and withdrew the application. The temporary protection order against our client was cancelled and our client can now move on, without a protection order against him.
